FactorIn is a product of Junket Holdings, LLC, a New Jersey limited liability company (“Junket” “we,” “us,” or “our”). This Privacy Policy (the “Policy”) explains what information we collect when you use FactorIn, why we collect it, and what we do - and don’t - do with it.

Please note that this Policy does not apply to information about you collected (i) by third party services, applications or websites, or advertisements associated with, linked to or otherwise accessible from FactorIn (including by a third party payment processor) or (ii) by third party individuals, financial institutions or financial advisors or companies with which you conduct transactions or communications facilitated through use of FactorIn. The information collected and received by such third parties is subject to their privacy policies and under no circumstance are we liable for the third party’s compliance therewith. We encourage you to review the privacy policies or notices of the applicable providers or those third parties for information about their practices.

We wrote this in plain English. If anything is unclear, email us at support@factorin.com and we’ll answer. By accessing and using FactorIn, you agree to that you have read and understood this Policy, and that, in exchange for access to FactorIn and the associated services, you accept and consent to the privacy practices (and any uses and disclosures of information about you) that are described in this Policy.

The short version

We collect the information that you give us, that we need to run the service, bill you, and keep your account secure, and that we receive from third parties that make our services available to you. Nothing else.
We do not use or share your private content to train AI models - ours or anyone else’s. When you dispatch runs to third-party AI providers, those providers receive your inputs to execute the work; what they do with those inputs is governed by their own terms, which we summarize below.
We use cookies to keep you signed in, remember your preferences, and understand how the service is used. You can control these in your browser.
We do not sell your personal information. We do not share it with advertisers.

1. Information we collect

Information you give us:

Account information: name, email address, password (stored hashed), and billing details if you subscribe to a paid plan.
Library content: the documents, notes, plans, prompts, recipes, tasks, and other materials you create, edit, or publish in FactorIn.
Communications: messages you send us through support, feedback, or other channels.

Information collected automatically:

Usage information: pages viewed, features used, timestamps, and similar activity data.
Device and connection information: IP address, browser type, operating system, and general location inferred from IP (city or region level, not precise geolocation).
Cookies and similar technologies: see Section 6.

Information from third parties:

Applicable law may require not only that we disclose the types of third parties with whom we may share personal information but also that we separately identify the categories of personal information we share with third parties for business purposes. These categories could include any or all of the following: payment information from our payment processor (we do not store full card numbers); personal identifiers; device and online identifiers and related information; demographic information; financial Information; government identifiers; legally protected classification characteristics; Internet, application, and network activity; location data; audio data; and authentication or account information if you sign in through a third-party provider.

Inferences We Derive From the Data We Collect.

We may use the information we collect about you to derive inferences for the services we provide.

“Do Not Track” Disclosures:

Your browser or device may include Do Not Track functionality. The services that we provide are not built to respond to “Do Not Track.” That means that, even if your browser is set to “Do Not Track,” our information collection and disclosure practices will operate in accordance with the standards set out in this Policy.

2. How we use information

We use the information we collect to:

Provide, maintain, and improve FactorIn.
Create and manage your account.
To notify you about changes to our policies.
To improve, enhance, modify, add to, and further develop our services.
To develop new services.
Process payments and send billing communications.
Send you service updates, security alerts, and important notices.
Respond to your support requests.
Detect, prevent, and address fraud, abuse, and security issues.
Comply with legal or contractual obligations.
With your consent, send you optional product updates or newsletters.

We do not use your private library content to train AI or machine learning models, and we do not share your private content with third parties for their AI training. We do not use your private library content for advertising. We do not read your private library content except when we need to investigate a specific abuse report, respond to a support request you initiated, or when required by law.

Content you publish to a public library is a separate matter - see Section 7.

We share information only in these situations:

With AI providers you choose. When you dispatch a run, your task, library context, and any specified inputs are sent to the AI provider you select (such as OpenAI, Anthropic, or Google) so the provider can execute the work and return results. Each provider has its own privacy and data-handling terms. Two situations:

When you use your own API keys (“BYOK”), your relationship with the AI provider is direct and governed entirely by that provider’s terms. You should review the privacy practices of any provider you use.
When you use our API keys, we send your inputs to the provider under FactorIn’s account. We select provider settings and account tiers designed to prevent training on prompt inputs where the provider offers that option, but we cannot guarantee any provider’s practices universally. We will name the providers we use and summarize their relevant terms in-app.

With service providers who help us operate FactorIn, such as cloud hosting, payment processing, email delivery, and error monitoring. These providers only access the information they need to perform their work for us, and they are contractually required to protect it.

When you publish content publicly. Content you publish to a public library is visible to anyone. See Section 7.

When required by law, such as in response to a valid subpoena, court order, or other legal process. We will notify you before disclosure unless prohibited by law.

In connection with a business transaction. If FactorIn is acquired, merged, or reorganized, your information may be transferred as part of that transaction. Any successor will be bound by this Privacy Policy or provide you notice of changes.

We do not sell your personal information. We do not share it with advertisers or data brokers.

As we believe reasonably appropriate to protect the rights, privacy, safety, or property of you, the applicable providers, our partners, Junket, and others.

For any other notified purpose with your consent.

4. Data retention

We keep your account information and library content for as long as your account is active. If you delete content, we remove it from active systems promptly within 30 days but may keep a copy for backup as required by applicable law. If you delete your account, we remove your personal information within 30 days, except for records we are required to keep for legal, tax, or accounting purposes.

Content you publish to a public library may remain available to others who have downloaded or forked it, even after you delete it from your account. This is inherent to public publishing and works similarly on platforms like GitHub.

5. Data security

We use industry-standard measures to protect your information, including encryption in transit and at rest, access controls, and regular security reviews. No system is perfectly secure, and we cannot guarantee the security of your personal information transmitted through FactorIn. If we experience a data breach that affects your personal information, we will notify you as required by law.

The safety and security of your information also depends on you. Where we have given you (or where your provider has given you) a password for access to certain parts of FactorIn, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

6. Cookies and similar technologies

We use cookies and similar technologies to:

Keep you signed in.
Remember your preferences.
Understand how FactorIn is used, so we can improve it.
Detect and prevent fraud and abuse.

We use both first-party cookies (set by FactorIn) and a limited number of third-party cookies (set by service providers we use for analytics and error monitoring). You agree that we can disclose information required for these third-party service providers to provide services. We do not use advertising cookies or share cookie data with advertising networks.

You can control cookies through your browser settings. Disabling essential cookies may prevent parts of FactorIn from working correctly.

7. Public content

FactorIn lets you publish libraries and content publicly. When you publish content:

It becomes visible to anyone who visits FactorIn or accesses our public content through the API.
Others may view, download, copy, or fork it in accordance with the license you select.
The license you select applies to the content. FactorIn does not claim ownership of your content or grant additional rights beyond what your chosen license allows.
Metadata about the content (title, author, publication date, license) is also made public.
Because published content is public, it may be accessed and used by third parties - including for AI training - in accordance with the license you chose. If this concerns you, choose a license that restricts such use, or keep the content private.

If you later unpublish content, it becomes inaccessible through FactorIn going forward, but anyone who accessed or forked it while it was public may retain their copy.

8. Your rights

You can:

Access and review the information in your account at any time by logging in.
Correct inaccurate information in your account settings.
Export your library at any time, in full, in plain markdown.
Delete your account and associated personal information by contacting us or using the account-deletion tool in your settings.
Opt out of non-essential marketing communications by using the unsubscribe link in any such email.

California residents have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to know what personal information we collect, the right to delete it, and the right to opt out of any sale or sharing. We do not sell personal information. To exercise your rights, contact us at support@factorin.com.

9. Age restriction

FactorIn is for users 18 years of age or older. We do not knowingly collect information from anyone under 18. If we learn that we have collected information from someone under 18, we will delete it. If you use FactorIn or our services, you are guaranteeing that you are at least 18 years of age or older.

10. Service availability

FactorIn is currently offered to users in the United States only. We store data in US regions. If you access FactorIn from outside the United States, please be aware that your information is processed in the US and is not subject to any regulations set forth other jurisdictions, such as the UK and EU.

California Users. If you are a California resident, California law may provide you with additional rights regarding our use of your personal information. California residents should be aware that this section does not apply to the following:

Personal information covered by certain sector specific privacy laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA) and its implementing regulations, the California Financial Information Privacy Act (FIPA) and the Driver’s Privacy Protection Act of 1994; or
Other information subject to an exception under the California Consumer Privacy Act (CCPA).

Under the California Consumer Privacy Act (“CCPA”), and subject to certain limitations and exceptions, you may have the following rights with respect to information we have collected about you that constitutes personal information under the CCPA:

To request access to more details about the categories and specific pieces of personal information we may have collected about you in the last 12 months (including personal information disclosed for business purposes);
To request deletion of your personal information;
To opt-out of any “sales” of your personal information, if a business is selling your information; and
To not be discriminated against for exercising these rights.

To exercise your access, deletion, or data protection rights, where applicable, you can submit a request by contacting us as described in the “Contact Us” section below. You may be required to provide additional information necessary to confirm your identity before we can respond to your request.

Responses to such requests will be completed within a reasonable period of time (and within any time period required by applicable law). Please note, however, that certain information necessary for compliance with our own legal obligations or to establish, exercise, or defend legal claims may be exempt from such requests.

11. Changes to this policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or through the service before the changes take effect. Continued use of FactorIn after the changes take effect means you accept the updated policy.
